A HAZMAT permit is required when construction, expansion and/or use of certain premises that constitute hazardous occupancies under the building code. Permits for the use of hazardous material can only be issued to businesses that are located in area where one-third of less of the tracts within the test area are being used for residential purposes.
There are 2 types of permits. A Restricted permit under which manufacture, processing, generation, storage or use of hazardous materials will take place only within buildings or structures that are so designated on the tract to which the permit pertains. An Unrestricted permit under which the manufacture, processing, generation, storage or use of hazardous materials may take place both within buildings or structures and out of doors on the tract to which the permit pertains.
1) They have to post the orange permit on site where the material is housed on site. 2) A restricted permit is valid only for enterprise operations within the building(s) and/or structure(s) identified thereon for that purpose. 3) The holder of an unrestricted permit may construct additional buildings or structures, convert the use of buildings or structures or undertake expansion of existing buildings or structures upon the tract to which the permit pertains without first obtaining a new permit under this article. The holder of an unrestricted permit may not expand the size of the tract to which the permit pertains without first obtaining a new permit for the expanded tract.
Sec. 28-244. - New permits; etc. Applications for new permits, where required under this division, shall in all respects be treated as original permit applications under division 2 of this article. Without limitation, land use determinations shall be based upon uses in existence at the time that the new permit application is filed. (b) Applications for construction or expansion under registrations that are filed under section 28-243(c) of this Code shall be processed in the same manner as new restricted permit applications. Land use determinations thereunder shall be based upon uses in existence at the time that the application for construction or expansion is filed. 2) Apply for building permit. Commercial Plan Analyst reviews plans for determination if HAZMAT permit is needed. 3) Application for restricted or unrestricted permit is submitted to Planning Staff at 611 Walker on the 6th Floor at the front desk if determined that a restricted or unrestricted Hazardous Material permit is required.

Fire Department Initial project permit review identifies if the Unrestricted or restricted permit is required. Once slated for permit requirement application must be submitted to Planning for approval.

1. Submit plans at the permit counter. Plans will be routed to the Fire Department and Structural. 2. Customer will be notified when plans are ready for pickup. 3. Applicant will be notified in the comments if this permit is required.
4. If required applicant must submit the plans and a copy of the Hazardous material permit at the front counter, located at 611 Walker 6th Floor.
