A municipal setting designation is a deed restriction that prohibits the use of impaired shallow groundwater as potable water.

After Approval

MSD Application along with the Ordinance of Support are sent to the Texas Commission on Environmental Quality (TCEQ) for further processing

Conditions and Exceptions

Requirements: Enrolled in a State of Federal cleanup program; Thorough investigation confirming that the groundwater plume is stable or decreasing, and delineated; Source of contamination has been removed; A third party Professional Engineer (P.E.)or Professional Geologist (P.G.) must certify application

  • A pdf file of the application and all supporting document 
  • Two hard copies of the application, supporting documentation, and an electronic file.
  • Certified mailing list and regular mailing list on an excel file,
  • The metes and bounds of proposed MSD boundary as a text file.
  • One notarized copy of Form 0455-1 “Affidavit of Ownership or Control” must be submitted under separate cover.
